Dealer's Reports
Legal Requirement
In 1999 all Commercial Marine Dealers were required by law (Section 187A-1 of the Hawaii Revised Statutes) to submit a Commercial Marine Dealer's Report (Dealer's Report) for each month that they are in the business of purchasing marine life. This report is to be submitted to HDAR no later than the 10th day of the following month.
The purpose of the Dealer's Report is to verify that all fishermen selling fish to a dealer or at an auction have a Commercial Marine License (CML) and that what they report on their Fisherman's Reporting System forms is true.
A Commercial Marine Dealer is defined as any person or business who sells, exchanges, or is an agent in the transfer of marine life obtained directly from a Commercial Marine Licensee for sale or exchange to the public at retail.
A Commercial Marine Licensee is defined as anyone who has been issued a Commercial Marine License.
Marine life is defined as any type or species of saltwater fish, shellfish, mollusks, crustaceans, coral, or other marine animals including any part, product, egg, and offspring thereof; seaweeds and other marine plants including any part, product, seed or root thereof.
Data Collected
Each monthly Dealer's Report contains the name, address, phone number and dealer number of the dealer submitting the report and month and year for which the report is submitted. If the dealer bought no fish during that month he should place an "X" in the box indicating that he did not purchase any marine life.
If he did purchase any marine life that month, the dealer must enter the date of the purchase and the name and CML number of the fisherman selling the fish. For each species purchased the dealer must enter the total pounds, the number of each species and the price paid.
